    Im surprised people are still trying to dispute and argue about how 'JN doesnt have copyright for WN'.

    If my common sense understanding is correct, and im in no way an expert on copyrights or anything like that, the WN could be considered a rough draft and the LN an edited, completed product. That implies a direct link between them, theorizing that they can then be considered similar enough for copyright to cover both of them under any publishing deal.

    ergo, my common sense says to me: JN, with the agreement of the author (which is probably the case), can enforce action over the WN.

    DISCLAIMER: Im in no way an expert on copyright, publishing deals or any legal stuff. the above is just my opinion based on info from OP and a dash of logical common sense.

    Well, actually "IMO" what you're saying is actually the complete polar opposite. Even if there are similarities or anything, IMO anything that is different is different, that's it. It doesn't matter whether the things inside is the same, if you have a different cover, that thing is different, even if slightly. Note that I'm talking about "difference that makes things different" not copy paste things. Best way to say it is probably if you create a picture, and you created another picture with only 1 pixel of difference, both of them is still different, and both have different copyrights since they were created by the same creator, not blatantly copied to be a knockoff, and they are intended to be different.

    J-novel have the license of translating the LN to english. That's it. The LN. And currently, they are in no way, allowed to interfere with the WN. And even if they do have the license for the WN, they have the license to translate the LN and WN into English, not the permission to DMCA the english translation. You know what i mean?

    Sure, people might think that I'm dumb for differentiating them, but it could be different. Except if J-novel showed us the proof of the agreement between the author and them that he/she has also given them the right to DMCA other english LN WN translation, or the writer which is the legal owner of the copyright give an open statement to the public that he/she has given the permission to J-novel to DMCA.

    This whole problem could be solved easily if J-novel played it calmly, since their releases are quick and in good quality. If things get going people soon are also gonna hop on their train, or if they asked the writer to DMCA Roxism for WN copyright.

    But instead, they tried to be the white horse, and trying to make themselves look like a victim and weed out the competitors. I'm not saying that translation is not illegal, it is. But you don't have the authority to force them to comply to the rule, the one who owns the authority is the writer. Although admittably Roxism is quite stupid for just ignoring the mail and putting fanfic tag on it.

    Note that i don't support any side, and i am no expert on copyright either, I've written IMO at the top. Please do correct me if I'm wrong.

    Here's a disclaimer from narou webnovel.

    I might be wrong, but this bolded part that I did states this point.

    Unless it's specially noted, the copyright of the novel that is posted belongs to the author (except in some works).

    In addition, saying something like fanfiction and the likes doesn't protect you too. In an example, JK rowling sent cease-and-desist notices to pornographic Harry Potter Fanwork.

    Fanfiction is mostly illegal without obtaining the author's permission; the legal exception is fair use and you have to be substantially different in content (there are other points of Fair Use, but I doubt Roxism's version is anything but fair).

    I believe the comments have pretty much been done to death about the situation, but you guys do understand that Roxism is morally and legally in the wrong, right?

    PS: I don't know if JNovel has the permission of the author to issue a DMCA, but the copyright of one's work in Narou belongs to the author unless otherwise stated. That is all.

    That's not how it works. If JNC license the WN (I know, they haven't, I'm just going along with the scenario), what they buy is not the right to translate the WN, but the exclusive right to publish it in English. Anyone can translate, it's the publication part that requires authorisation (yes, posting on Wordpress counts as publication, it's being publicly distributed online). Therefore anyone else who posts translations of the WN would be infringing on JNC's exclusive publication rights, and they would be able to take legal action. The publication right becomes their property, and so they are able to legally protect it.

    I think your only ranting because he has patreon and You dont. You want their patreon to be yours so you can earn the 100$.

    Well anyone can do what ever they want.
    and for your information japanese is free to read online and fansubber out there can do what ever he want to translate.

    Naruto is even more popular than your WN/LN and it was LICENSED!. yet u see other fansubber out there no license translating the crap out of it.. Guess what did any of them get sued by VIZ MEDIA for translating? No right. lol

    You can do what ever you want bro. This is not your job. Just because u have rights from author for translation doesnt mean you own that shit and have the rights to sue other translator cuz they r not on ur High level of DAO translator.

    Only the Author + Company had the right to chase dem for copyright issue... u are not part of them.

    Not sure if you're trolling, but almost everything you said is wrong.

    Even though you can read a Japanese WN for free, they are still the property of the author and whatever publisher or publishers they've licensed the work to. If you take their work and repost it on another site without the author's permission, you're doing something illegal. You may never get sued for it since the publisher would likely never make more from the suit than it costs them to file it. Stiill, they can still file a takedown notice to an unauthorized translation, or failing that, the hosting company for the translation website.

    Translating a novel into another language without the consent of the creator is dubiously legal to begin with. The author and publisher can license another publisher to publish a translation of the work in another language. If they do that, then any other published translations in that language by anyone else are no longer legal.

    j-novel.club has their own revenue stream from monthly subscriptions. At most, they'd want the Patreon removed so others can't profit from the publishing rights that JNC pays the author and original publisher for.

    The only part of your post that may be true is the part about VIZ and Naruto. I don't know much about Naruto, so I have no clue if VIZ ever tried to take down Naruto translations or not. Do you have any proof that VIZ didn't take action against any translations?

    It's not "dubiously legal". You are allowed to translate for your own use. Posting your translations on a blog is flat out breaking the copyright law. Translation is a derivative work, publishing any kind of derivative work requires an authorization of the copyright holder, regardless whether the work, or the author of that work has any presence in your country.

    And to all the dumbasses in this thread:

    Syosetu is not public domain. Works published on Syosetu are not public domain.

    If you think otherwise try selling a bunch of songs recorded from a public radio. Tell me how that worked out for you once your local RIAA equivalent sues your sorry ass into bankruptcy.

    What we, translating groups ( except those licensed like WW/Volare/Gravity, or working with explicit permission ), do is very much illegal and not a single fan translator in existence has any doubts about this. We do this because the legal copyright owners either can't afford or don't care enough to shut us down.

    Quarkboy has every right to do what he does. Hell, he has every right to fall on us like a ton of brick, if he wants. Roxism's reaction to his very reasonable and polite request is quite insulting. And all of you folks raging on him are quite fucking sad.

    But u see d Rant here is not about the Author or Publisher going after the guy "Roxism HQ"
    Its the translator guy going after another translator because he claim he has licensed to translate it. Only the Author/Publisher can go after Roxism HQ and sue him/her for copyright.

    and Yes VIZ Media did not take any action against any translator out there. You can see alot there still translator there whos doing Boruto which is also licensed by VIZ.. They dont do anything because without these translator.. Their work would not be popular :O

    Roxism HQ isnt making money from doing translator. Patreon is free of choice, You are not being forced.. just wait couple days and the next chapter will be free 2 read. Isn't that the same as Webnovel / Patreon translator doing.

    You can see lot of translator out there translating Novel without even license and doing patreon lol.

    But J-Novel club is the authorized publisher for the English market. They have the license, they publish the books. They hold all the rights.
    It's not "Quarkboy the translator" shutting down "Roxism the group". It's "Sam Pinansky, the CEO of publisher J-Novel Club" protecting his licenses and acting on his contract, which also very likely demands he protects the IP.
