Let's assume that the Zombie Outbreak of 1495 happens again today. You are approached by a horde of shambling, rotting, noseless zombies. They are not dead, not in the clinical sense, they still have a pulse, their bodies, although rotting and infected, are still performing their cellular functions and their brains still have electrical impulses. But they do not have access to higher brain function and approaches people because it's a stimulus. But if they get close to people, they will infect people. So, in this case, is it legal to shoot zombies? Whether in the head or on the body? They are not conscious of what they're doing and can't make decisions on their own, but is self-defense enough justification to shoot them in the head? Would modern law hold you responsible for killing a living human when you shoot dead a zombie?
It's sort of a moot point unless there's an organized group / nation / faction powerful enough to live in some area totally cut off from the rest of the world, who would actually take that step in case someone actually finds zombies and kills them. At the start of any outbreak, there would likely be serious doubts about doing it, but sooner or later someone would open fire and others would follow suit, unless they somehow can reverse-engineer the zombie virus and cure them of it within a few hours or days at most, unless it's an extremely local zombie event .
Well it would depend on where you are but in general the idea of self defense is reasonable force, if you reasonably think you have to kill something to save your own life and you aren't doing that because you were caught doing something stupid or illegal then it is legal.
Oh jeez it's too early for this. I would say yes, it would be legal, but unless there's an apocalyptic anarchy scenario there would probably be need for zombie hunting licenses unless it is acute self-defense. Because 1) even normal corpses are health hazards and needs to be properly disposed, zombies would require educated people do deal with, 2) there would be a need to identify them and notify family members of their fate and final resting place. Dental ID, ect. And finally 3) nobody really wants a bunch of trigger happy crazies gunning down zombies in a society functional enough to have laws and a government. Except the trigger happy crazies I guess. Justified, in the case of society collapse, but otherwise... really, no one wants to see their grandmother shuffling around, suffering from endless murderous hunger in the first place. No one ESPECIALLY wants to see said zombified granny getting her head blown off with a baseball bat by someone who thinks it's funny.
this is me if i ever get a chance to torture one of those woke fks Spoiler: not for the weak of heart
Yes, but this begs the question: Since Christianity calls suicide a sin and Catholics will not deal with the body of a person who commits suicide, will God put you in jail or execute you for committing suicide?
Let's take a totally different case to understand this. If a horde of wild animals wreak havoc in city, the wild life inspectors tranquilize them and take them away. If it's a carnivore They'd do the same unless it has eaten human flesh, cause then it is a threat to human life, it will be shot down. The same way, if it's a non harmful zombies than atleast they'd try immobilizers, but if it's has you say "contagious" then for the safety of other humans, they'd be shot down. Personally I don't mind shooting those zombies, it's mercy to free them of the suffering.
Generally speaking, it really depends if you're doing it for self-defense. The level of threat they face towards you gives you more freedom as to what to do against them. But if they aren't really a threat, then it depends if they're still considered "humans" or a person with rights. But seeing as though the government still functions as a whole knowing that the laws remain intact, I'd say you need jurisdiction, license, or other legal rights in order to do so.
I don't know if you're lacking sleep or you're high again. I'll be honest with you, these questions are idiotic in a sense that why should "destroying" zombies be a crime? As you say, they are "dead" as a proper human being. They are zombies in the truest sense excluding that their bodies are still alive, but the cognitive functions as a human are long gone. Also their decaying body and as agents of the infection, they should be confirmed dead or in this case non-living dead. Yeah, I won't be using the word undead here.
