A third time for the same crime. It's already illegal to charge someone twice for the same crime. If he does it again, yes, he can be charged. And while he's certainly guilty, if the prosecutors don't follow the law while convicting him, it's right that he gets off. Anything else would set very bad precedents.
First of all, he is 83 years old, it is nearly safe to assume that he will not be raping anyone. Second, of course he can be charged for new crimes. The protection from being charged again only applies to the case that was now overturned. Third, I think you misunderstood why he was released. He was released because the prosecutor messed up and caused a 5th amendment violation, ending in the release we see today. He was promised that incriminating statements he made in a civil case against him would not be used in the criminal case.
