The statement that translating without permission is illegal is factually incorrect - it only becomes illegal once it is shared. For personal use, it is not illegal.

Not sure, it could fall under the "Fair use" principle. Particularly "Effect upon work's value" and possibly "Purpose and character of the use".

 

Sharing a translated work without permission would be copyright infringement of the original work. However, there is more to it than just 'it's illegal' like the claim.

 

If the "infringing use has had on the copyright owner's ability to exploit his or her original work" is absent, then it should have been fine. But that was prior to QI existence. So all the CN translations done before QI, should be in a grey zone area.

and all you need is consent from author, when it is translated by you into another language you own the copyright for that in that language which is legally your ownership

this translated novel issue is the same as an English Song translated into other languages, with the same rhythm. Dude do they applied copyright for that???

 

IMO, America copyright law is too strict, punitive and expensive. It almost game over as soon as you get the lawsuit (or legal threat?) that you might as well pledge guilty and beg for leniency. It is not surprising if it applied to literature and translation as well. I haven't heard fan related case but I can be wrong. There is no chance that a Chinese or Japan or other language fan base forming community to translate America literature into their language. Who dares?

On the other hand, Japan is more flexible. And it a win-win for everyone, mostly.

China, for better or worse allow the international fans community flourishing. IMO, it getting better that even local Chinese author expending to international market and cooperate with established fan group. Whether for fun or/and profit, this all happen at their own term. And this term or even contract can be re-negotiate if necessarily or at worse, sue for justice. Everything changed when the Fire QI attacked.
