As far as my understanding, that Asuna does not show up SAO until past 2012 in the light novel. Where as Emilia is already there in 2012. I didn't know they tried to do this. I can honestly tell you, that while they try to claim their library as a subscription, many courts would see it as buying a digital copy and therefore inheritable. Sure I know they try to cover their asses with legal jumbo but the fact is (the youtube video doesn't reflect this) they would most likely loose 90% in any court today. The main reason they would loose is that they advertise BUY 9.99 $ instead of Lifetime subscription 9.99 $. Some smart lawyer probably drafted their EULA however courts have overruled those before. Oh, and I can promise you GameStop would pay your legal fees. The reason why steam is currently ambiguous is because they want to kill physical retailers. If you no longer own the games you pay full retail price for then GameStop and others would suddenly have huge advantage. No way in hell would Steam and game developers lower their price on new games with 50-75% to compete.
