"Including all common-law and federally-registered trademarks, the work cannot ever contain any more trademarks because it hasn't acquired 'secondary meaning'. If you do so again, your company will be forced to go bankrupt".

-Marvel and DC Comics both have a TM on the word superhero, which dates back to at least 1917 (or so I read). Since many people with think of either comic company when hearing that word, it is a generic trademark that has achieved a secondary meaning-type status. For a federal court to tell both companies "This is a generic trademark and thus you have to have it terminated for good", a person with deep pockets would have to make that case to present the suit.

I would like to write a book or comic with “super-hero”, “super hero”, or “superhero” in the title. However, despite the fact that large corporations have Congress (by extension, SCOTUS) wrapped around their corporate fingers. That said, if a person was to sue them, what charges would those corps sue for?

When it comes to trademarks on his works, he put in his will that "for each series that I made, after the last copyrighted work I made during my life lapses, all TM with each said series is now public domain. If my estate and their licensing partners are to truly respect my intent/wishes, they will follow this request and not re-file any TM related to any of my works after all my published works have entered the public domain. This applies if even I have unpublished works published after I die."

-When a book, comic book, or movie series has lapsed all its copyright for all of its stories written/illustrated by the creators, the estate and licensing partners should lose all TM on the series. By this, I mean the estate/licensing partners lose all their TM for this series and they cannot re-file any TM related to this series under any circumstances. Why don’t we have laws saying that when all the stories creators worked on for a series they made lapses out of copyright, all the TM also expire? It would make sense there should be when a TM acts as a perpetual copyright, which is forbidden by the Copyright Clause. In other words, they are breaking that mandate.

*Now, artwork variations are fine. For example, there are many artistic variations of Peter Parker as Spider-Man, particularly his signature web-suit, but they at least look somewhat similar to the original Peter Parker.

-The importance of the public domain cannot be underestimated. So many story ideas are developed using it and those in turn, after so many decades, will be re-used by others. I think the 56-year coverage under the Copyright Act of 1909 was the best for duration length. Funny how this is the era many Disney classics, of which were largely public domain-based stories, were made yet Disney lobbies for continued copyright length. Hypocritical and/or ironic indeed. Sometimes Work A (book, short story, movie, or TV epi.) fell into the American public domain because they were not renewed. However, Work B (book, short story, movie, or TV epi. that is the source material for Work A) is still copyrighted. Being that Work A is a derivative work of Work B, this means that Work A can be effectively pulled from the public domain and re-copyrighted.

I don't care if Work A is still copyrighted, when a work falls into the American public domain, it should stay and not be allowed to get re-copyrighted. By doing so, what is effectively "public domain infringement" has been committed. Now, making a derivative work of that public domain work (colorization, digital re-mastering, deleted scenes, etc.) is different. However, I think such a derivative work should be labeled something like "director's cut" or "special edition" or "or digitally re-mastered edition" to show it is a bit different from its predecessor. Also, trademarking a public domain name, image, or even sound acts as a perpetual copyright. I am applying this more for comic book, book, and movie characters. Something like "Mona Lisa Films" with the famous painting and a globe behind her for that company's logo is fair game.

-Redef has an 8/27/18 article called "How the Paradox of the Term ‘Original Series’ Explains the Video Industry (Netflix Misunderstandings, Pt. 4)", written by a writer named Matthew Ball. He wrote that "excluding sports, a streaming service has five core types of programming (fairly simplified)". The first core type, the Developed Originals", is what I consider a true Netflix original in the traditional sense of the word "original".

Here is a paraphrased explanation of that type: The "Developed Original" is made, financed, and distributed by a network or streaming service that will be airing/streaming that show or movie. With this, the network/service can brand that show how it wants, has complete control of the budget and creativity, has full say on whether they should cancel or renew, and usually has control of all IP-related rights. A "Developed Original" could come from a production company/writer that has a first-deal look with Netflix. Netflix merely has to cover production costs to buy/distribute the show.

What is a first look deal? Party A (a creative talent and their production company) is in a contractual agreement with Party B (another production company) that Party B will have first dibs to consider a project from Party A. This is because Party B is giving financial aid to Party A, so they are the first to get distribution/production rights.

      To those that read this, I get that piracy/counterfeits are an an issue in that many industries. However, a somewhat reverse form of piracy is an equally important and overlooked issue by those that are for adhering to copyright laws. This is a re-copyrighting a work that legally expired in the USA then is removed from the Amer. public domain. Here is a specific case.

      John T. Aquino is an author and attorney representing Maryland and D.C. He has 3/30/2012 blog entry called "Legal Problem Solving: It's a Wonderful Life"* and it describes about how It’s a Wonderful Life got a copyright restoration. The Abend ruling was the key for that to happen. Likewise, a 5/8/2008 blog entry called "Infringement by Copying Public Domain Works" (on a no longer-updated Blogspot page called The Patry Copyright Blog) was written an IP attorney named William Patry**. That blog post talks about how Paramount Pictures used the Abend ruling on The Andy Griffith Show episodes 80-95.

      How does this happen? If a work is now public domain but its source material is still copyrighted, that source material, adaptation rights, and music rights can all be used to restore that work to copyright (federal or common law). It doesn't help that Viacom has a label/division called Melange Pictures that has some USPTO-registered trademark on the classic film title. So, even if It’s a Wonderful Life and the short story it was based off were both public domain (federal and common law) right now, you could really not use the classic film name for the title of a film re-make. Obviously, the exception is getting a license from Viacom.

      Retroactive copyright extensions, copyright restorations, and trademarks all act as de facto permanent copyright for a work. Let’s not forget that perpetual copyright is forbidden by the U.S. Constitution. However, what is deemed as “limited times” is a valid argument. For a work to truly be public domain here, all common law and federal copyrights associated with the orig. version of that work are now public domain and could not be restored. Likewise, any trademarks associated with the work either ineligible from ever receiving common law or federal protection (past, present, and future) or such TMs were protected but now lapsed and cannot ever have any new TMs formed.

      Federal courts have ruled that pre-1972 sound recordings fully become public domain from federal and state/common law copyright protections) on 2/15/2067. So, even though an American film may be public domain because of lack of renewal, the soundtrack is still copyrighted. So, even if the classic 1946 Christmas film failed to renew its copyright or lapses its current 95-year protection, it still has a layer of copyright protection via soundtrack until that date. Thus, it can have over 120 years of federal and common-law copyright protections with the music. What's also hectic is figuring when the 2nd copyright expires (for the movie itself, not necessarily the music).

      If I was an IP attorney, I would go on record saying "These said works are public domain and staying there. Also, even if the early entries of a movie series or TV series are still copyrighted, the later entries that didn't have their copyrights renewed cannot be restored, except under a ‘Director's Cut’-type situation. As such, It’s a Wonderful Life, outside of derivative versions, should not be restored, as it legally expired. The Abend decision and similar rulings should apply only to derivative works that are currently copyrighted. If filming a Transformers movie in a theater with your iPhone is copyright theft, then a copyright restoration of It’s a Wonderful Life is public domain theft. Also, I question how SCOTUS could ever justify this being allowed should this info be presented to them".

      The problem with changing American laws is when they become ex post facto laws. Latin for "out of the aftermath", these are laws that apply retroactively. U.S. Constitution Section 9, Article I, Clause 3 and Section 10, Article I, Clause 1 respectively forbids Congress and a State from passing ex post facto laws. Assistant Prof. of Law Evan C. Zoldan at the University of Toledo College of Law wrote a nearly 60-page research paper called "The Civil Ex Post Facto Clause" on 7/23/14 but revised it nearly 16 months later.

      On its Social Science Research Network page, the Abstract says the following (italics are mine): "Since its first interpretation of the Ex Post Facto Clause in Calder v. Bull, the Supreme Court consistently has held that the clause applies only to retroactive criminal, but not civil, laws. The consequences of this distinction are far-ranging, permitting, for example, states to keep offenders behind bars after they have served their sentences. The Court’s distinction between civil and criminal retroactivity is based wholly on Calder’s historical conclusion that the original meaning of the Ex Post Facto Clause included criminal laws only. This article demonstrates that Calder’s historical analysis is wrong."

      Also, all these rants are a moot point by me admitting to read fan translations because of points like the series won’t ever get an official release here (digital or print) or I prefer to read chapters vs. buying a whole vol. to read it. Factoring the time, money, and clearance of rights, a Crunchyroll-type site for manga that has hundred of manga series to read, including those that are weekly or monthly chapters, vs. pay-to-read vol. approach, I would be using that a lot more. I promise.

      Now that my rants are out of the way, this is a question to the American copyright experts or attorneys here. I am asking for your personal opinion and not what any federal courts have ruled on such matters: how is it legal that a work that legally expired its copyright here get re-copyrighted? I thought the idea and rule was that what goes in the American public domain stays there.

      -Plenty of people, especially Eng. dub VA such as Josh Grelle and Carli Mosier, are against piracy. What are their thoughts on stealing from the public domain? This is not from a legal sense, but rather an all intents and purposes sense. It has been millions of times just in the last 6.5 years and SCOTUS allowed Congress to do this stealing spree.

      For the record, the above case is called Golan v. Holder. Millions of foreign works that failed to renew their copyright here or that didn't meet registration requirements became public domain here. On the other hand they were still copyrighted int their native country. SCOTUS and Congress might say it was done to comply with foreign copyright treaties. Yeah right. We have a history of violating domestic and foreign treaties. Why should this be any different?

      If one is to bring up piracy, public domain theft should also be addressed.

      Property being stolen? That's a correct statement. However, I rarely see the same argument said about public domain infringement.,That is, retroactive copyright extension or trademarking something in the public domain or copyright restoration. Such restoration has happened to many foreign/domestic works that legally expired from failure to renew their copyright, even when based of off still-copyrighted source material. Such restoration also has happened because they did not meet the copyright formalities (like the circle "C" or properly registering it) required at that time.

      Public domain infringement is not an officially-recognized term, but more of a practical term. Copyfraud (false claim of copyright) carries only a $2500 fine whereas copyright infringement carries up to $250,000 in fines.

      What is your take on public domain infringement? I get that piracy is a big issue but, while public domain "piracy" doesn't really affect people like you, shouldn't the same level of scorn be all applied to all form of piracy: trademark, patent, copyright, and public domain?

      At least in the USA, copyright is supposed to progress the arts and sciences (constitutionally speaking). However, literary estates and media companies, especially Team Disney, often lobby Congress for longer and stricter copyright terms, especially by paying Congress members. Because of this, the purpose of Amer. copyrights has essentially been corrupted to where content creators are to be paid for their work.

      Now, a lot of people will say it was extended to comply with foreign copyright or trade agreements. I think it was to just further milk their older catalog titles, especially "Steamboat Willie". Besides, since Congress has past treaties or agreements that they violated (especially with Native Americans), why should this "comply with foreign agreements" explanation be so special?

      I have more than once on FB and Twitter have admitted that my public domain rants are essentially a moot point as I do admit to frequenting scanlation sites. Outside of fair use, permission, and the work being public domain, such a fan translation is copyright infringement.
      So, why don't we see more criticism of "public domain infringement" in such new stories, outside of the copyright-critiquing sites like Techdirt?
